Delhi High Court calls SpiceJet promoter Ajay Singh to next hearing. The dispute between SpiceJet and KAL Airways / Kalanithi Maran is looking far to get over.
Indian Court calls SpiceJet Promoter
Ajay Singh, along with promoter is also the Managing Director of the airline.
Ajay Singh has been called because of a case of non-compliance of court’s order. In year 2020, Delhi High Court ordered Ajay Singh to present an affidavit which includes the assets and liabilities of the airline. However, even after 3 years, the airline has failed to do so.
An application was filed by Kalanithi Maran telling the court about the same. Counsel from KAL Airways Maninder Singh said that under Order 21 of the Civil Procedure Code 1908, if a person fails to file an affidavit of assets and liabilities, he can be arrested and put behind civil prison.
Counsel from SpiceJet said that they will explain about this in the next hearing. In between, Justice Yogesh Khanna directed SpiceJet Managing Director and Promoter to be present in person in next court hearing.
Next hearing on September 5. Ajay Singh expected to be present.
The whole dispute
In start of this year, there was a settlement between both the parties after Supreme Court encashed the Rs 270 crore bank guarantee and asked the airline to pay remaining Rs 75 crore within 3 months.
After 3 months, SpiceJet failed to pay the amount as directed by the Supreme Court. Kalanthi Maran moved to Supreme Court again. This time, the court directed the airline to pay Rs 380 crore immediately. Kalanithi Maran has rejected any talks over settlement.
